"Visitor" is someone who merely browses our Website, but has not registered as Member.

"Member" is an individual that has registered with us to use our CME Service. "Service" represents the collective CME functionality and features as offered through our Website to our Members.

"User" is a collective identifier that refers to either a Visitor, a Member or a Contributor. “Sponsor” refers to a third party that has contracted with Context HG to host the site and site Content.

“Contributor” refers to a health care practitioner who has agreed to fulfill a contract agreement with a Sponsor.

“Content” collectively refers to all text, information, graphics, audio, video, and data offered through our Website.

“Material” refers to any text, information, graphics, and data provided or posted by a User, Visitor or Member of the Site.

“Adverse Event” or “AE” refers to any undesirable experience associated with the use of a medical product in a patient or any untoward medical occurrence in a patient or clinical investigation subject administered a medical product and which does not necessarily have a causal relationship with this treatment or product.

Scope of Use

CME activities presented on this website are offered for continuing education purposes only. Practitioners must continue to exercise their professional judgment when selecting diagnostic tests and therapy specific to each patient’s medical needs.

This Website is only intended to be used for medical education purposes. The Website should not be used as a source of information to guide clinical decision-making or to support patient consultation.

Users are responsible for all the Material they post to the Website, including the truthfulness and accuracy of all content, and responsible for obtaining any required authorizations in connection with such Material. Users will not upload or post any Material that a) they do not have the legal right to upload or post; b) infringes any party’s copyright, trademark, trade secret, patent, or other proprietary rights; c) is unlawful, defamatory, abusive, harassing, obscene, tortious, libellous, trade libellous, or invasive of another's privacy; d) contains viruses or other code that may detrimentally interfere with the Sponsor, Context HG or other users’ systems; or e) imposes an unreasonable load on the system.

Context HG reserves the right to remove any Material from the Site at its sole discretion, including any Material that does not comply with the provisions of this Terms of Use agreement or that could subject Context HG to legal liability.

Legal Compliance

Users agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations, healthcare-related and otherwise, regarding the use of the Website.

Users agree to comply with all of their professional and legal obligations in connection with any information or material that they upload or post to the Website. Users will comply with all privacy laws and other requirements applicable to physicians and other healthcare professionals regarding confidentiality and personal information, healthcare-related or otherwise.

Specifically but without limiting the general application of the present section, Users will not disclose any personal information or personal health information of patients or other individuals, or disclose any information that identifies or that could potentially identify (eg, if combined with other information) any patient or other individual.

Context HG reserves the right to investigate complaints or reported violations of our Terms of Use and to take any action deemed appropriate, including but not limited to canceling Member accounts, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information, as allowed under the Privacy Policy.

Continuing Medical Education and Continuing Education

When you register for a Continuing Medical Education (CME) or a Continuing Education (CE) activity through one of our Web sites, we may collect certain personally identifiable information from you such as your name, email address and mailing address. If you are a pharmacist and wish to receive CE credit, you are also required to provide your NAPB # and month and day of birth. In addition to personally identifiable information, we may collect aggregated non-personally identifiable information about the activities undertaken by our users. We may use the information that we collect through CME/CE activities in several ways:

We may work with several accredited companies who are accredited by the Accreditation Council for Continuing Medical Education (ACCME) to provide continuing medical education for physicians. As a joint-provider, we are required periodically to submit aggregated data about CME participants and the CME activities we certify. We also may provide personally identifiable information to other accredited CME/CE providers who certify CME/CE activities posted on our Web sites, as required by the ACCME and other accrediting bodies. These reports may include personally identifiable information about you and credits issued to you, for the purpose of maintaining records that you can request from the accredited provider for up to six (6) years

Commercial supporters of CME/CE activities on our Web site will receive only aggregated data about CME/CE activities that are relevant to their interests and/or the courses they support;

Our Editorial and Customer Support Staff may have internal access to files containing personally identifiable information, including evaluation forms and aggregated CME /CE participant information. These files can be accessed in order to respond to your questions or comments. Our staff may also use personally identifiable information, including registration information and evaluation data, in assessing educational needs and planning marketing activities.

We may use the information we collect as otherwise permitted in our Privacy Policy.

Conflict of Interest Policy

Context HG requires identification of conflict of interest and initiation of its resolution during the planning phase of program production. Regardless of whether or not there is direct commercial support for the CME/CE activity, all individuals who are in a position to control or direct the content of an activity (faculty, medical writer, key planning committee members) sponsored by Context HG are required to disclose to Context HG any personal financial relationships with the manufacturer(s) of any commercial product(s) and/or provider(s) of commercial services discussed in an educational presentation, and with any commercial supporters of the activity in place in the 12 months preceding the activity. Potential faculty members who refuse to disclose financial relationships will not be contracted for faculty services and will not be involved as a planning committee member.

Intellectual Property

The Website may contain service marks or trademarks as well as those of affiliates or other corporations, in the form of words, graphics, and logos. Use of the Website does not constitute any right or license for use of such service marks/trademarks, without the prior written permission of the corresponding service mark/trademark legal or beneficial owner. The Website is also protected under international copyright laws. The copying, redistribution, use or publication by Users of any portion of the Website is strictly prohibited. The use of the Website does not grant Users ownership rights of any kind in the Website. The functionality and programming of Context HG’s Website is also proprietary, and protected by law.

General Terms

The Legal Terms shall be treated as though it were executed and performed in Quebec, Canada, and shall be governed by and construed in accordance with the laws of Quebec, Canada, without regard to conflict of law principles. In addition, Users agree to submit to the personal jurisdiction and venue of such courts and for the purpose of the Legal Terms, the Users, Visitors, Members and Context HG all elect domicile in the judicial district of Montreal. Should any part of the Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content in the Website conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence. The latest copies of the Legal Terms will be posted on the Website, and Users should review all Legal Terms prior to using the Website. After any revisions to the Legal Terms are posted, the User agrees to be bound to any such changes automatically via use of the Website.
